Davis-Bacon Act: Worker Rights & Approved Fringe Benefits

The Davis-Bacon Act guarantees prevailing wages and benefits on federally funded construction projects. Here's what contractors and workers need to know — and how WCPW ensures you're fully covered.

What Is the Davis-Bacon Act?

Enacted in 1931, the Davis-Bacon Act (DBA) requires contractors and subcontractors on federally funded or federally assisted construction projects to pay workers no less than the locally prevailing wages and fringe benefits for corresponding work on similar projects in the area.

The Act applies to contracts exceeding $2,000 for the construction, alteration, or repair of public buildings or public works. Wage determinations are issued by the U.S. Department of Labor's Wage and Hour Division (WHD) and must be incorporated into every covered contract.

Compliance is not optional — violations can result in contract termination, debarment from future federal contracts, back wage liability, and civil penalties. WCPW helps contractors navigate every requirement from bid to project closeout.

Worker Rights Under the Davis-Bacon Act

Workers on covered projects are entitled to specific protections that contractors must honor on every pay period.

Prevailing Wage Rates

Workers must be paid no less than the wage rate listed in the applicable wage determination for their job classification — including base hourly rate plus fringe benefits.

Overtime Protections

The Contract Work Hours and Safety Standards Act (CWHSSA) requires overtime pay at 1.5x the basic rate for hours worked over 40 per week on covered contracts.

Certified Payroll Records

Contractors must submit weekly certified payroll reports (WH-347) to the contracting agency, documenting wages paid to each worker by classification.

Anti-Kickback Protections

The Copeland Anti-Kickback Act prohibits contractors from inducing workers to give back any portion of their earned wages. Violations carry criminal penalties.

Posting Requirements

Contractors must post the applicable wage determination and the 'Notice to Employees' poster (WH-1321) at the job site in a prominent location accessible to all workers.

Classification Accuracy

Workers must be classified and paid according to the actual work performed, not a lower-paying classification. Misclassification is one of the most common — and costly — violations.

Approved Fringe Benefits Under Davis-Bacon

Contractors can satisfy the fringe benefit portion of the prevailing wage obligation by providing bona fide benefit plans. WCPW helps you structure and document these correctly.

The Davis-Bacon Act allows contractors to meet the fringe benefit component of the prevailing wage rate by contributing to bona fide benefit plans. These contributions must be made irrevocably to a trustee or third-party plan — they cannot be taken back by the employer.

Health Insurance

Medical insurance premiums paid on behalf of workers qualify as approved fringe benefits. Plans must meet bona fide standards — providing genuine benefits, not nominal coverage designed solely to offset wage obligations.

Dental & Vision Coverage

Dental and vision insurance premiums are recognized fringe benefits under Davis-Bacon. These can be offered as standalone plans or bundled with medical coverage to maximize the fringe credit.

401(k) & Retirement Plans

Employer contributions to qualified retirement plans — including 401(k), pension, and profit-sharing plans — count toward the fringe benefit obligation. Contributions must be made to an independent trustee.

Life Insurance

Employer-paid life insurance premiums qualify as bona fide fringe benefits. Term life policies paid directly by the employer to an insurance carrier are the most common form used on public works projects.

Vacation & Holiday Pay

Paid vacation and holiday pay can be credited toward the fringe benefit obligation if the plan is established in advance and contributions are made to a bona fide fund or trust.

Apprenticeship & Training

Contributions to bona fide apprenticeship or training programs registered with the DOL or a recognized state apprenticeship agency qualify as approved fringe benefits.

Cash in Lieu of Benefits

If a contractor does not provide a qualifying benefit plan, the full fringe benefit amount must be paid directly to the worker as additional cash wages on top of the base rate. This is called 'cash in lieu of benefits' and is the default when no bona fide plan is in place. WCPW helps contractors evaluate whether establishing a benefit plan is more cost-effective than paying cash in lieu.

Understanding Wage Determinations

Wage determinations are issued by the WHD and specify the minimum wage rate and fringe benefit amount for each labor classification in a given geographic area. They are project-specific and must be incorporated into the contract before work begins.

There are two types: General Wage Determinations (published and updated regularly) and Project Wage Determinations (issued for a specific project upon request). Contractors must use the correct determination for the project location and type of work.

Wage determinations are found on SAM.gov. If the correct classification for a worker's duties is not listed, contractors must request a conformance — a process WCPW manages on your behalf to ensure no worker is underpaid and no contractor is exposed to liability.
